Out-of-State-Counsel
Our lawyers have acted as counsel and local counsel for numerous clients, including Fortune 500 companies, in both State and Federal court. In that capacity our lawyers have handled such complex matters as Qui Tam claims, tortious interference claims, state super fund claims, non-compete agreements, labor disputes, trade secrets and MTBE litigation.
Our firm is always prepared to assist out of state counsel practice before Vermont’s state and federal courts through pro hac vice admission and affiliation. Admission to state court is through motion by a member of the bar pursuant to Vt. R. Civ. P. 79.1. Out of state attorneys must also file an attorney licensing statement form with a fee. Admission to federal district court is by motion by a member of the bar pursuant to Local Rule 83.2. In federal court original proceedings may be filed by an attorney prior to admission pro hac vice, but the time for a responsive pleading to be filed does not start to run until associated local counsel files an appearance.
Our firm is technology friendly and able to work with out of state counsel by transmitting documents electronically in various formats. Our lawyers are also versed in electronic filing through the U.S. Bankruptcy Court’s CM/ECF site and the U.S. District Court’s RACER/PACER system.
